The Health Service Procurement (Wales) Bill was laid before the Senedd on 13 February 2023. The Member in Charge of the Bill is the Minister for Health and Social Services, Eluned Morgan MS. The Senedd will debate the general principles of the Bill (the Stage 1 debate) on 9 May.
The Bill is a framework Bill. It does not contain any substantive law but provides Welsh Ministers with powers to make regulations:
- A ‘disapplication power’ which will enable the Welsh Ministers to disapply provisions of the UK Procurement Bill, currently progressing through Parliament, once enacted. That Bill would otherwise apply to the procurement of health services.
- A ‘creation power’ which will enable Welsh Ministers to introduce a new separate procurement regime for these health services in Wales.
